Executing accurate lien searches is a vital tool of any secured party.  The Third Circuit Court of Appeals’ decision in Yale Factors v. Jersey Tractor Trailer Training, Inc. reminds us of this.  Years of litigation occurred between competing secured parties simply because a lien search was not property performed.  As is often the case, better upfront due diligence could have saved everyone a lot of time and money.
