Undivided Interest Properties and what can you do with them?
Mr. Bryant examines common individual rights which, in certain combinations, constitute property including:
- Tenancy-in-Common
- Joint Tenancy with Right of Survivorship
- Community Property
- Community Property with Survivorship Agreement
- Life Estates
- Homestead Rights
Mr. Bryant also examines the legal process known as Partition, by which, in some instances, the courts can divide or otherwise dispose of those rights, and in particular the new Texas Uniform Partition of Heirs’ Property Act, which was enacted by the last Texas Legislature and became effective on September 1, 2017, and how this new act interplays with the existing “traditional” Partition process.
