Italian Cowboys Partners, Ltd. v. The Prudential Insurance Co. of America is a difficult case dealing with fraudulent inducement. The Texas Supreme Court held that a “no representations” clause in a lease agreement is not enough to disclaim reliance by a tenant on representations made by a landlord during negotiations. Although the clause being litigated is from a commercial lease, the holding extends far beyond the landlord/tenant situation and affects many types of contracts.
